Program Description:

Developing a theory of a case is a crucial aspect of legal strategy. The starting point for developing the theory is a thorough investigation of the facts, the identification of the issues in the case, a consideration of the applicable law and the identification of the evidence available on each issue. This will include a consideration of how to get the necessary facts into evidence. A case theory is a detailed, coherent, accurate story of what occurred. A good theory will capture key elements of the case. The theory should be developed early and will serve as your blueprint of the case. In this webinar, you will learn how to create a theory for your case and to present the facts your evidence supports and the arguments on which your theory is based. There are two main questions that must be proven in arbitration and should be part of developing your theory of the case. The experienced AAA Labor Arbitrators will share practice tips, strategies and a checklist that will assist you in persuading the Arbitrator in your case.
