Program Description:

In labor arbitration, evidence refers to any information, documentation, testimony, or other materials the parties in a dispute present to support their claims or defenses. The Arbitrator uses this evidence to make an informed decision regarding the resolution of the labor dispute. Evidence can include written documents, witness statements, records, and any other relevant information that helps establish facts or substantiate arguments presented during the arbitration process. Evidence is used to establish the proof of a fact; the degree of proof required depends on the nature of the case. Generally, Arbitrators look for clear and convincing proof in the majority of the cases. Experienced AAA Labor Arbitrators will provide best practices and tips for advocates on presenting evidence in labor arbitration.
