The past two years have seen the development and promulgation of rules by arbitral institutions allowing parties to seek emergency relief – the equivalent of a temporary restraining order or preliminary injunction. Prior to this, parties would need to go to court to obtain this relief pending arbitration.

The impact of emergency relief arbitration rules is significant and it is likely that there will be litigation on this issue in every federal circuit. As a result, arbitrators, advocates, judges and transactional lawyers need to have a thorough understanding of these rules and of how they may be used in arbitration.

This 60-minute recorded webinar reviews the new emergency relief arbitration rules and analyzes whether they may compel federal courts to reverse their longstanding policy to allow court injunctions pending arbitration.
