With social media technologies, the line between workplace misconduct and off-duty conduct that is subject to just-cause discipline has become increasingly blurred.  Employees, managers and union representatives need a clarification of these concepts.

An experienced AAA® Labor Arbitrator and two skilled labor professionals will examine the interface between these concepts from their perspectives, using case scenarios and other current materials. Attendees will learn to distinguish off-duty misconduct in the private sector and the public sector as well as consider constitutional issues that may arise.

The speakers will also address:
• the employee’s expectation of privacy after working hours and in their social media content vs. the employer’s business interests.
• the requirements of workplace nexus and/or notoriety.
• the special case of public-sector employees who serve as role models and violate a public trust (e.g., teachers, police, firefighters).
• the effect of criminal behavior (arrest/conviction/incarceration).
• the employer’s monitoring of social media vs. employee’s First Amendment rights.
