60 Minutes

Arbitrators sometimes spend more time writing awards than performing any other aspect of their job, so it makes sense that great care should be exercised in crafting the award. Arbitrators have only one chance to “get it right,” as their ability to modify an award is severely limited by the doctrine of functus officio.

Awards must be written with three audiences in mind: the parties, their advocates, and the courts. They should, therefore, be timely, in the proper form, easily understood and leading to a logical conclusion, and within the scope of the arbitration agreement. If more than just a “bullet” award, an award should also inform the parties of the reasons behind the decision and show that the arbitrator heard and carefully considered the losing party’s arguments.

During this 60-minute recorded webinar, you will learn the secrets to writing construction arbitration awards that are clear, complete and convincing. Since protecting your awards from vacature is such a critical component of award writing, the rules governing their form, scope and timing will be thoroughly examined.

This presentation will help you to be better equipped to write awards that are upheld and generate greater party satisfaction.

WHO WOULD BENEFIT FROM THIS PRESENTATION – Arbitrators, academics, and anyone interested in the arbitration process.
