Attorney fees, costs and post-award interest often constitute a significant portion of an arbitration award. While entitlement to these items is typically governed by the agreement between the parties, this presentation will focus on the legal authorities that inform the application of those contract provisions in commercial arbitrations, and will include discussions of: 1) Whether to award attorney fees, the basis for an attorney fee award, and factors to consider when determining the amount of attorney fees to award; 2) Cost awards; 3) Post-award interest; and 4) The most efficient practices for obtaining briefs on these issues from counsel.

This program does not qualify for the AAA's annual Arbitrator Continuing Education (ACE) requirement.
