Attorneys can be in a better position to monitor the negotiating behavior of their counterparties and to advance the needs of their clients if they become more conflict resolution literate and mediation savvy.

Develop a more in-depth understanding of what the role of the mediator is, preparing for mediation, mediation strategies, and what goes on in a commercial mediation to help you and your clients get the most value from the process.

There’s a lot to absorb, including:
• Principles of interest-based negotiation.
• Selecting the appropriate mediator.
• Pre-mediation client counseling: BATNAs, RPs, BAGs, priority setting, risk assessment, present-value determination, and negotiation strategy.
• Working with the mediator.
• Framing an advantageous opening statement in mediation.
• When to collaborate and when to compete.

AAA EDUCATIONAL PROGRAM SCHOLARSHIPS AVAILABLE
